Chapter 7 Bankruptcy
  • Chapter 7 bankruptcy is sometimes called "liquidation" bankruptcy -- it cancels your debts, but you might have to let the bankruptcy court liquidate (sell) some of your property for the benefit of your creditors

  • The whole Chapter 7 bankruptcy process takes about four to six months, costs $299 in filing and administrative fees, and commonly requires only one trip to the courthouse

  • Filing for Chapter 7 bankruptcy puts into effect an "Order for Relief" -- known informally as the "automatic stay." The automatic stay immediately stops most creditors from trying to collect what you owe them
Chapter 13 Bankruptcy
  • Chapter 13 bankruptcy, sometimes called reorganization bankruptcy, is quite different from Chapter 7 bankruptcy

  • In a Chapter 13 bankruptcy, you use your income to pay some or all of what you owe to your creditors over time

  • In a Chapter 13 bankruptcy, you don't have to hand over any property, but you must use your income to pay some or all of what you owe to your creditors over time

Prohibited Acts By The Creditors

The automatic stay remains in effect until

  • A judge lifts the stay at the request of a creditor; the debtor gets a discharge; or the item of property is no longer property of the estate
Stop Wage Garnishment
  • Wage garnishment is a state court order to an employer to deduct part of an individual's pay. This money is then sent to the court to be distributed to creditors in order to satisfy debt amounts.

  • Upon filing Bankruptcy an immediate order is sent to terminate the garnishments. This means zero dollars are legally aloud to be deducted from your wage and in addition to that all money garnished prior to your filing is recoverable.
Stop Foreclosure & Save Home
  • Stopping foreclosure is another positive side effect from filing for Bankruptcy. If your house is being foreclosed on due to not making mortgage payments, filing for Bankruptcy will put a hold on the process

  • In addition to not being foreclosed you will then have the ability to try and save home or remain in the home for the remainder of the proceeding
